OPINION ON THE DRAFT LAW OF GENETIC FINGERPRINTING
The Advisory Council on Human Rights prepared a memorandum on a draft law relative to the identification of individuals through genetic fingerprinting. This draft law had been referred to the Council by the Ministry of Health.
The Council made several recommendations, including:
- The need to respect the inviolability of personal data;
- The consent of the person concerned;
- The need for judicial supervision in criminal cases;
- The creation of an independent national body to organize the field;
- The absolute prohibition of selling or giving the human genome;
- Prevention of discrimination between persons based on genetic characteristics;
- The creation of a committee composed of members from the ministries of health, Justice, Interior and Islamic Affairs and the Council to prepare a draft law regulating the field.
