Recommendation on the advisory capacity of the Council in studying international conventions and human rights law
In its 10th ordinary meeting, held on 11-12 July 2003, the Advisory Council on Human Rights (CCDH) studied the provisions of Dahir (Royal Decree) # 1.00.350, dated 10 April 2010, relative to the advisory capacity of the Council in the harmonization of national laws with international human rights conventions. The Council discussed all aspects of this point. Therefore, the Council submitted a proposal to His Majesty the King to order that any international convention, to be ratified by the government, draft law and regulation and draft laws directly related to or include measures to implement any human right, should be referred to the Council for study and opinion, before ratification. The Council suggested that it will be even more useful if it receives the preliminary drafts during their study phase by the competent authorities. In this case the Council will have enough time to study them and submit its relevant proposals. In order to guarantee respect for its position as a specialized and independent institution, the Council suggested that those drafts should be submitted to the Royal Cabinet. The Royal Cabinet then refers them to the Council, which shall submit its relevant advisory opinions to His Majesty the King.
